Although jail time is possible in a misdemeanor case, the greater concern for many first-time offenders is the possibility of a permanent criminal record. A conviction for theft, trespassing, shoplifting or other misdemeanor offense looks bad on a job application and has serious implications for future employment options.

Under Virginia law, misdemeanor criminal offenses are categorized into 4 classes, each with its own range of sentences. Specifically, the four classes of misdemeanors, and the possible sentences are:

  • Class 1: up to 12 months in jail and / or a fine of up to $2,500
  • Class 2: up to 6 months in jail and / or a fine of up to $1,000
  • Class 3: a fine of up to $500
  • Class 4: a fine of up to $250

If Virginia law doesn’t specify a specific punishment for a particular misdemeanor, it will be treated as a Class 1 misdemeanor criminal offense.

Felonies

A felony conviction can result in a loss of basic constitutional rights, including the right to vote and the right to possess a firearm. A felony conviction can also result in a significant sentence of incarceration.

In Virginia, there are six classes of felonies, the maximum sentence for each is specified below:

  • Virginia Class 1 felony: death or life imprisonment and possibly, $100,000 fine
  • Virginia Class 2 felony: life imprisonment or 20 years in prison and possibly, $100,000 fine
  • Virginia Class 3 felony: not less than five, no more than 20 years in prison, and possibly, $100,000 fine
  • Virginia Class 4 felony: not less than two years, no more than 10 years in prison, and possibly, $100,000 fine
  • Virginia Class 5 felony: not less than one year, no more than 10 years in prison (this charge does carry the possibility of no more than 12 months in jail and no more than $2,500 fine)
  • Virginia Class 6 felony: not less than one year, no more than five years in prison (this charge does carry the possibility of no more than 12 months in jail and no more than $2,500 fine)
